GENERAL TERMS AND CONDITIONS NAGELLACK24.CH
 
All deliveries are based on the following terms of sale.
 
1. prices and payment
1.1 Item prices are subject to change without notice.
1.2 Retention of title
1.3 Purchase by invoice with partial payment option (POWERPAY)

As an external payment provider, MF Group/POWERPAY offers the payment option ‘Pay by invoice’. You can simply pay for your online purchase by invoice using the order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview.

When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it using the payment method selected. By selecting purchase by invoice, you are also agreeing to our GTC, POWERPAY’s



2. delivery
2.1 Delivery to the customer
NAGELLACK24.CH is not responsible for wrong deliveries due to incomplete and/or wrong delivery addresses. The customer is obliged to check the correctness of his data when ordering and bears the additional costs for wrong deliveries.
2.2 Delivery costs
The delivery costs for subsequent deliveries, which are caused by NAGELLACK24.CH, are at the expense of NAGELLACK24.CH and are not charged.
2.3 Damaged goods
All deliveries are well insulated, protected and packed for shipment.
If the customer discovers damage to the packaging or the contents, it is his responsibility to report this immediately to the delivery service (Swiss Post.). This can be done directly to the delivering employees of the delivery service or via the service hotline of the delivery service for damage reports. All claims for damage must be made to the delivery service.
In the event of damage, the customer is obliged to retain all cartons or packaging and insulation materials so that they can be presented to the delivery service in connection with a damage report (if requested).
NAGELLACK24.CH will not make damage reports and claims in the name of the customer to the delivery service.
2.4 Delivery of wrong articles
If NAGELLACK24.CH sends the customer articles, which he did not order, the customer must inform NAGELLACK24.CH within 48 hours (or until the next following working day). Either NAGELLACK24.CH organizes in this case the collection of the package at own expense or organizes the return of the wrong articles by the customer to us. All costs, which arise for the customer for the return of wrong delivered articles, will be charged with the next order of the customer. The subsequent delivery of the correct articles takes place immediately after receipt of the returned articles and at the expense of NAGELLACK24.CH .
Excluded are delivery times as well as delivery bottlenecks of our suppliers, if the correct articles are not in stock. In this case the delivery of the correct parts takes place immediately after NAGELLACK24.CH has received them from its suppliers.
2.5 Incomplete delivery
If the delivery by NAGELLACK24.CH is erroneously incomplete, the customer must inform NAGELLACK24.CH within 48 hours (or by the next following working day).
2.6 Delivery bottlenecks
If NAGELLACK24.CH cannot deliver the ordered articles within the communicated time due to delivery bottlenecks of its suppliers, NAGELLACK24.CH will inform the customer. Basically NAGELLACK24.CH delivers an order to the customer only if it can be delivered completely. On explicit wish of the customer, NAGELLACK24.CH also carries out partial deliveries.
 
3. orders
3.1 Binding nature of the order
Who orders via order form online, by email, verbally, enters into a binding and legally binding contract with NAGELLACK24.CH and is obliged to accept and pay for the goods. NAGELLACK24.CH is not obligated to accept an order and to carry out to the specifications. An order can be rejected by NAGELLACK24.CH at any time without cost consequences.
3.2 Return of goods
If the customer wishes to have the goods taken back, he must send a corresponding e-mail or letter by post, stating the order number and the exact item description(s). It is impossible to return used goods. If we discover when opening the package that the goods have been used, the package will be returned to the customer at his expense. The resulting shipping and postage costs when returning the goods to NAGELLACK24.CH are fully borne by the contractual partner.
It is basically the task of the customer to ensure that he orders the correct parts for his desired purpose.
The customer bears the costs for the return shipment. The return costs are a flat rate of CHF 7 for parcels and CHF 1.20 to CHF 3.70 for letters. These costs will be charged to the customer
3.3 Guarantee
a.) In the case of defects or in the case of the absence of assured characteristics NAGELLACK24.CH is entitled after its choice first to the rework of the faulty article or replacement. The dispatch of the repair object or a replacement delivery is charged to the contracting partner. After the 2nd failure or in case of impossibility of the repair or replacement delivery within an appropriate time the contracting partner is entitled to the cancellation of the contract (redhibitory action).
b.) The warranty does not include the elimination of defects caused by external influences or operating errors. Warranty claims do not exist furthermore, if the contracting partner does not follow operating or maintenance instructions or if the contracting partner or third parties not authorized for this have interfered in the contract goods or have carried out changes in it, or if expendable items have been used which do not correspond to the specifications of NAGELLACK24.CH.
3.4 Credit notes
If NAGELLACK24.CH grants a credit note to the customer, this will be charged with the next order or credited to the shop account. If the customer wishes a disbursement of the credit note and agrees NAGELLACK24.CH that, then the disbursement takes place within 30 working days via credit note on the indicated bank post office account of the customer. It is task of the customer to name the correct bank account. NAGELLACK24.CH is not responsible for transfers to wrong accounts due to wrong data of the customer.
 
4. products
4.1 Guarantee
It is the task of the customer to check received articles for errors and to inform NAGELLACK24.CH in writing within 48 hours (or by the next following working day) after delivery.
For all articles offered by NAGELLACK24.CH in the shop, the warranty of the manufacturer is valid.
The guarantee of most manufacturers contains only the repair and not the replacement of faulty parts. The delivery costs for faulty parts will not be refunded to the customer.
It is the customer's responsibility to keep all material (packaging, instructions, etc.) and documents (invoices, delivery notes, etc.) which are required in a warranty case.
Correspondence regarding warranty cases and/or any warranty claims will be sent exclusively by post. Complaints, claims, suggestions, inquiries, information, etc. regarding warranties will be received and processed exclusively by post.
4.2 Legality of the products sold
It is the customer's responsibility to check the legality of items before ordering. By ordering, the customer accepts that an item may be illegal for its intended use. NAGELLACK24.CH is not responsible for the use of an illegal article or the use of an article for an illegal purpose even if NAGELLACK24.CH is informed about the illegality of the article. Also NAGELLACK24.CH does not have to inform the customer about this circumstance.
Withdrawals or cancellations of orders due to the illegality of the article are not accepted by NAGELLACK24.CH.
4.3 Installation of articles
We recommend that the installation of the articles we offer is carried out by a suitable specialist. NAGELLACK24.CH is not responsible for the improper installation of parts and their consequences. Furthermore NAGELLACK24.CH is not responsible for damages, which result directly or indirectly from the installation or the use of an article, which was bought with NAGELLACK24.CH.
 
5. liability
5.1 Claims for damages
a.) Claims for damages by the customer against us, regardless of the legal basis, in particular for culpa in contrahendo, positive breach of contract and/or tort, including for damage not caused to the delivered product or the work performance itself, are excluded. This exclusion of liability shall not apply in the event of intent or gross negligence on our part or on the part of our vicarious agents.
b.) NAGELLACK24.CH does not take over any adhesion for escaped profit, indirect or indirect damage, which can develop for the buyer or a third.
 
6) Other regulations

NAGELLACK24.CH reserves the right to refuse customers, orders or services at any time without giving reasons.
NAGELLACK24.CH is not responsible for errors of the used shop software as well as for incorrect or wrong prices, product specifications, delivery times and orders, which are caused by such errors.
If individual regulations should be void or ineffective, this does not affect the validity of all remaining as well as the delivery conditions as a whole. Instead of the void or ineffective provision, the statutory provision or the provision that comes closest to it shall apply. Place of performance for all obligations from this contract is the place of the company headquarters of NAGELLACK24.CH. The place of jurisdiction is Dürnten (ZH).
Unless otherwise expressly agreed in writing, the applicable legal provisions under Swiss law and these General Terms and Conditions shall apply, even if the order is executed abroad.

 
All our sales transactions are exclusively subject to Swiss law.
